Job Seeker Terms and Conditions Agreement

Energy Jobs Network, an Oklahoma Corporation is a web based application service provider helping employers identify qualified job seekers and helping job seekers locate career opportunities. Once an individual completes the necessary online registration process, he/she automatically becomes a member of Energy Jobs Network (Job Seeker). 

Agreement

Job Seeker acknowledges, by his/her use of Energy Jobs Network, that Job Seeker shall have Job Seeker responsibilities identified in this Agreement. Energy Jobs Network shall have the responsibilities identified as Energy Jobs Network responsibilities in this Agreement. Candidate will automatically have membership in Energy Jobs Network until Job Seeker explicitly terminates his/her membership through online facilities provided at or through written instruction (e-mail) to Energy Jobs Network. Job Seeker may terminate membership in Energy Jobs Network at any time. In the event of any violation of this Agreement by Job Seeker, Energy Jobs Network reserves the right to terminate Job Seekers’s membership.

Job Seeker Responsibilities

Job Seeker acknowledges and agrees as follows:

1. Job Seekers's use of Energy Jobs Network is for the sole purpose of identifying and responding to job postings at Energy Jobs Network.
2. Job Seeker is solely responsible for the accuracy of information provided to Energy Jobs Network for use by others.
3. Job Seeker will not copy, modify, distribute or sell any proprietary information of Energy Jobs Network or its licensers available on Energy Jobs Network.
4. Job Seeker will use Energy Jobs Network in a manner which is ethical, legal, and not contrary to the interests of others.
5. Job Seeker accepts sole responsibility for any communication it may have with other users or Employer participants at Energy Jobs Network.
6. Job Seeker may only use those facilities which have been authorized for Job Seeker's use and if access is protected by a password, Job Seeker will not make its password or accounts available to others, nor will Job Seeker use the password or account of any other participant.

Energy Jobs Network Responsibilities

1. Energy Jobs Network.com will not disclose the name or address of candidate to prospective employers or others without the expressed permission of Job Seeker except in the case where Job Seeker has agreed to make his/her Profile public. (Expressed permission is granted when Job Seeker applies to a specific job on Energy Jobs Network. Job Seeker marks his/her profile as ‘public’ while registering on Energy Jobs Network.
2. Energy Jobs Network will not sell or distribute personal information from Job Seeker to any person or business. 
3. Energy Jobs Network will attempt to provide readily available access to Energy Jobs Network and work to make Energy Jobs Network performance adequate for its intended purpose and use. 
4. Energy Jobs Network will send e-mail to the Job Seeker only that is necessary to achieve the intended function of Energy Jobs Network and/or support the use of Energy Jobs Network.

Practice and Use 

Energy Jobs Network recommends that the Job Seeker use Energy Jobs Network as part of his/her overall job search strategy and also continue the use of other usual and customary job search activities and methods. Energy Jobs Network expressly does not assure or otherwise guarantee Job Seeker that any Job Seeker will find a job though Energy Jobs Network or that Energy Jobs Network services will identify any prospective Employer meeting Job Seeker's requirements. Energy Jobs Network makes no recommendation or endorsement of any commercial product, process or service which is mentioned or referred to at Energy Jobs Network. Energy Jobs Network expressly disclaims any warranty as to the accuracy of any information provided by an Employer on Energy Jobs Network and relies solely on the Employer to provide an accurate representation about the Employer and the Employer's job opportunities listed on Energy Jobs Network. Energy Jobs Network expressly disclaims any responsibility or warranty for the performance of the Internet or the security of any transmission over the Internet. 

Indemnification 

JOB SEEKER UNDERSTANDS THAT THE USE OF ANY INFORMATION OBTAINED THROUGH Energy Jobs Network IS AT JOB SEEKER'S OWN RISK AND AGREES TO INDEMNIFY, AND HOLD HARMLESS Energy Jobs Network FROM ANY CLAIMS, DAMAGES, LOSSES, LIABILITIES, COSTS AND EXPENSES, RESULTING DIRECTLY OR INDIRECTLY FROM CANDIDATE'S USE OF Energy Jobs Network.

Limitations of Liability Disclaimer

Energy Jobs Network MAKES NO REPRESENTATION OR WARRANTY OF ANY KIND RELATING TO JOBSEEKER'S USE OF Energy Jobs Network, OR THE INFORMATION PROVIDED AT Energy Jobs Network, INCLUDING, WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTIES OF ANY KIND; AND, IN ADDITION, ESPECIALLY MAKES NO EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OF SERVICES OR PRODUCTS, OR EXPRESS OR IMPLIED WARRANTY OF FITNESS FOR ANY PARTICULAR PURPOSE. IN NO EVENT SHALL Energy Jobs Network BE LIABLE FOR ANY DAMAGES, WHETHER DIRECT OR INDIRECT, CONSEQUENTIAL OR INCIDENTAL, GENERAL OR SPECIAL, OR PUNITIVE, RESULTING DIRECTLY OR INDIRECTLY FROM JOB SEEKER'S USE OF Energy Jobs Network OR ANY PART OR ALL OF THE SYSTEM BY WHICH Energy Jobs Network'S SERVICES ARE PROVIDED, DELIVERED OR MADE AVAILABLE FOR USE BY JOB SEEKER. Energy Jobs Network’S LIABILITY IN THE EVENT OF ANY LOSS OR DAMAGE SHALL BE LIMITED TO THE FEES AND CHARGES, IF ANY, PAID TO Energy Jobs Network FOR Energy Jobs Network SERVICES WHICH RESULTED IN SAID LOSS OR DAMAGE.

Venue 

Job Seeker agrees that Oklahoma law (regardless of conflicts of law principles) shall govern this Agreement, and that any dispute arising out of or relating to this Agreement shall be subject to the federal and state courts in Oklahoma.
